A BILL to amend article sixteen, chapter five of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section seven-c,
relating to providing public employees medical coverage for
the costs related to fertilization treatment and medications
for women receiving medical care for fertility.
Be it enacted by the Legislature of West Virginia:

That article sixteen, chapter five of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
seven-c, to read as follows:
ARTICLE 16. WEST VIRGINIA PUBLIC EMPLOYEES INSURANCE ACT.
§5-16-7c. Additional mandated benefits fertilization treatment and
medications.
(a) Notwithstanding any provision of any policy, provision, contract, plan or agreement applicable to this article,
reimbursement or indemnification for fertilization treatment and
medications may not be denied for any female between twenty-five
and thirty-five years of age upon an informed determination by a
qualified medical physician that such treatment or medications are
medically necessary to promote and increase the likelihood of
successful pregnancy due to verifiable medical considerations.
(b) The same deductibles, coinsurance, network restrictions
and other limitations for covered services found in the policy,
provision, contract, plan or agreement of the covered person may
apply to fertilization treatment and medications provided for under
this section.
NOTE: The purpose of this bill is to provide
public employees
medical coverage for the costs related to fertilization treatment
and medications for women receiving medical care for fertility.
